These Terms of Service are provided in English for compliance purposes. In case of any inconsistency between the English version and any translated version, the English version shall prevail.

By accessing or using the ToonBliss Art Studio website ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will notify you of material changes via email or a prominent notice on our website.
2. Service Description
ToonBliss Art Studio is an online tool that converts ordinary photos into images inspired by the artistic style of anime-style animations using artificial intelligence ("AI") technology.
The Service is provided "as is" and is intended for personal, non-commercial use unless otherwise agreed. We do not guarantee that the converted images will exactly match any particular artistic style or meet your expectations.

This service is NOT affiliated with, endorsed by, or in any way officially connected with any specific animation studio, production company, or their subsidiaries or affiliates. The style description used on this website is solely a stylistic descriptor and does not imply any official association.
3. User Registration and Accounts
3.1 Account Creation
You may need to create an account to access certain features. You agree to provide accurate, current, and complete information during the registration process.
3.2 Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
3.3 Account Termination
We reserve the right to suspend or terminate your account at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
4. User Content and Responsibilities
4.1 Your Content
You retain all ownership rights to the images you upload to the Service ("User Content"). By uploading User Content, you grant us a limited, non-exclusive license to process, store, and display your content solely for the purpose of providing the Service.
4.2 User Warranties
- You own the User Content or have the necessary rights to use it
- Your User Content does not infringe any copyright, trademark, or other intellectual property right
- Your User Content does not contain any illegal, harmful, or prohibited material
- You have obtained the consent of any identifiable individuals appearing in your User Content
4.3 Prohibited Content
- Depicts or imitates specific copyrighted characters, including but not limited to characters from well-known anime films
- Infringes any third-party intellectual property rights
- Contains nudity, sexually explicit material, or pornography
- Depicts violence, self-harm, or cruelty
- Contains hate speech, discriminatory content, or promotes harassment
- Depicts illegal activities
- Contains personal information of others without their consent
5. AI-Generated Content
5.1 Nature of AI Output
- Inadvertently resemble existing copyrighted works
- Contain artifacts, inaccuracies, or unexpected elements
- Vary in quality and style depending on the input image
- Not be suitable for commercial use without independent legal review
5.2 Disclaimer of AI Output
WE MAKE NO WARRANTIES REGARDING THE ORIGINALITY OR NON-INFRINGEMENT OF AI-GENERATED CONTENT. You use AI-generated content at your own risk.
AI Copyright Notice: Under current US Copyright Office guidance (2025), AI-generated images may not be eligible for copyright protection. The outputs generated by this service may not be copyrightable in your jurisdiction. You are responsible for understanding the copyright laws applicable to AI-generated content in your country before using the images for commercial purposes.
AI Identification: All images generated by this service include a digital watermark and metadata indicating they are AI-generated, in compliance with the EU AI Act (effective August 2026). Removing or altering this identification is prohibited.
5.3 Ownership of Generated Images
To the extent permitted by applicable law, we assign to you all rights to the AI-generated images produced through the Service. However, due to the current legal uncertainty surrounding AI-generated content, this assignment may not be legally recognized in all jurisdictions.

The Service, including its code, design, layout, and underlying technology, is owned by us and is protected by copyright and other intellectual property laws.

8. Payments and Credits
8.1 Points and Credits
Users may purchase points or credits to use the Service. Points are non-refundable, non-transferable, and have no cash value. Credits do not expire. New users receive free credits upon registration.
8.2 Free Trial
We offer a free trial with limited daily conversions. Free trial conversions include a watermark. Users must create an account to access additional credits.
8.3 Refund Policy
Due to the digital nature of our service, all purchases of credits are final and non-refundable. Refund requests for duplicate charges or billing errors must be submitted via email to yangpeng007x@gmail.com with the subject line "Refund Request". We will process approved refunds within 10 business days.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold us harmless from any claims arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

These Terms shall be governed by the laws of the United States and the State of New York, without regard to its conflict of law provisions.
13. Dispute Resolution & Arbitration
13.1 Informal Resolution
Before filing any claim, you agree to attempt to resolve the dispute informally by contacting us at yangpeng007x@gmail.com. We will attempt to resolve the dispute within 30 days.
13.2 Binding Arbitration
Any dispute arising from these Terms shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in English via written submissions or telephone, at the arbitrator's discretion. Judgment on the award may be entered in any court having jurisdiction.
13.3 Class Action Waiver
YOU AGREE THAT ANY PROCEEDINGS TO RESOLVE DISPUTES WILL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE ACTION.
13.4 Exceptions
Notwithstanding the above, either party may bring individual claims in small claims court, or seek injunctive or equitable relief in a court of competent jurisdiction for intellectual property infringement.

15. Repeat Infringer Policy
We maintain a policy of terminating the accounts of users who are determined to be repeat infringers of copyright or other intellectual property rights. A repeat infringer is a user who has been notified of infringing activity more than twice or whose uploaded content has been removed more than twice.
We reserve the right to terminate accounts at our discretion, including for a single instance of egregious infringement.
